General

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you”) with THEBES (hereinafter referred to as “THEBES”, “us”, or “we”) at the THEBES desktop website and mobile website. By using and/or placing an order at thebes.design, you agree to be bound by the terms and conditions set out herein (the “Terms & Conditions”). Please make sure you have read and understood the Terms & Conditions before placing your order.

Only persons of legal age (18 years or older), who are not under guardianship, can place an order at thebes.design.

The inclusion of any products or services on thebes.design at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time. We reserve the right to amend these Terms & Conditions from time to time without prior notice to you. The version of the Terms & Conditions that will apply to your order will be those on thebes.design at the time you place your order.

At THEBES, we want to provide you with the best possible online experience. To make this possible, we need to ensure that our service runs like clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the axelarigato.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including but not limited to spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these Terms & Conditions.

 

Events

Our events are 18+, ID is mandatory for admission.

By signing up for or attending one of our events, you grant Axel Arigato permission to use photo and video content containing you from the event.

Our mission is to create a safe and inclusive environment, in everything we do. Therefore, we have a zero-tolerance policy for aggression, discrimination, and sexual harassment.

Withdrawal of Order

Once an order has been successfully placed, we cannot issue changes or cancellations on this order. Once you have received your unwanted order, please return this back to our warehouse in accordance with Section Returns for a full refund.

 

Returns

You have the right to return your order within 30 days of receiving it. If you have been charged for the items, you will receive a refund once the package has been processed at our warehouse, which will include the standard delivery cost of your return.

Should you choose to keep certain items and only partially return your order, the delivery cost will not be refunded. If you wish to return your order, please use the pre-printed return form in your parcel, and return the item(s) to us as set out.

*Please note that we cannot accept returns that have not been sent using our pre-printed return label. If you send your return with your own choice of courier, we will not receive the parcel at our warehouse, nor will we be able to give you a refund on your order. We are not responsible for any shipping cost or lost packages if the order is not sent with the pre-printed label.

We guarantee a refund for any returned items, provided that all items are returned in the same condition they were in upon receipt. This means the items should not have been damaged, soiled, washed, altered, or worn (you may try items on indoors) and that any labels or tags should still be intact.

 

All our parcels contain a pre-printed return form for you to use if you decide to return any items. In certain countries and/or markets, we reserve the right to charge a return fee when refunding the order. This cost intends to cover the freight cost of the return.

We will provide a refund using the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 14 days of receiving your returned goods at our warehouse. If the item you have received is defective, please notify us promptly and return the item in the same way as stated above. We will, for any products deemed defective, provide a full refund, including the costs of delivery and return.

 

Our Liability

Nothing in these Terms & Conditions shall exclude or limit Axel Arigato’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms & Conditions, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach. THEBES is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms & Conditions where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on thebes.design shall be limited to the total price of your order.

 

Colors

We make all reasonable efforts to accurately display the attributes of our products, including composition and colors. The color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors.

 

Guarantee

THEBES complies with the statutory warranty provisions, so please reach out to us if the goods you have purchased are defective. If you would like to complain about obvious material or manufacturing defects, including transport damage, please let us know by contacting our emmons@thebes.design within 48 hours of receiving your order and providing photos along with your order number.

 

Assignment

THEBES reserves the right to assign or pledge to third parties any claims for payment which have arisen in connection with the delivery of goods.

 

Severance

If any part of these Terms & Conditions is disallowed or found to be ineffective by any court or regulator, the other Terms & Conditions shall continue to apply.

 

Ownership of rights

All intellectual property rights, such as trademarks and copyrights at thebes.design remain with THEBES and its subsidiaries or licensors. Any use of thebes.design or its contents, including copying or storing such content in whole or in part, other than for your own personal, non-commercial use, is prohibited without the permission of THEBES.
